Marketing Consent (Email & SMS)

The short version

We don't add you to a marketing list unless you sign up. When you sign up, we tell you exactly what you're signing up for. Every email has an unsubscribe link. Every text says how to stop. We don't buy lists. We don't share yours. If you go quiet for 18 months, we ask if you still want to hear from us.

01 Our position on marketing

We market to people who asked us to. Not people who landed on our site once. Not people whose email we found in a database. Not people who didn't opt in. We follow CAN-SPAM, TCPA, and the spirit of those laws as well as the letter.

02 How we collect consent

  • Filling out the newsletter signup form on cmykink.io.
  • Checking a clear, separate opt-in box on a project intake or contact form.
  • Asking us in person or over email and confirming in writing.

Consent is recorded: when, where, and what you agreed to receive. We keep that record while you're subscribed.

We do not use pre-checked boxes. You opt in by an affirmative action: typing in your email, checking a box, replying yes.

03 What you're signing up for

Right now, that means our newsletter: occasional emails from CMYK Ink with news from the studio, work we've shipped, things we're thinking about. Cadence: typically once or twice a month. Sometimes less.

We may add SMS in the future. If we do, we ask for separate, explicit consent for it. SMS opt-in is not assumed from email opt-in.

We don't mix transactional and marketing on the same channel without saying so. A project status email is not a marketing message.

04 How to unsubscribe

Every marketing email includes an unsubscribe link in the footer. Click it. You're out within 10 business days at the outside (usually instantly).

For SMS (if and when we offer it): reply STOP. You stop receiving messages.

You can also email hello@cmykink.io with the subject "Unsubscribe" and we'll remove you.

Unsubscribing from marketing does not unsubscribe you from project-related communications if we're working together. Those are not marketing.

05 The 18-month rule

If you've been on the list for 18 months without opening anything, we send one re-permission email asking if you still want to be subscribed. If you say no or don't respond, we remove you.

06 What we don't do

  • We don't buy or rent email lists.
  • We don't scrape emails from LinkedIn, websites, or business cards we collected without explicit consent.
  • We don't share our list with third parties for their marketing.
  • We don't send marketing to anyone who unsubscribed, ever (unless they re-subscribe themselves).
  • We don't cold-text. SMS marketing is opt-in only.

07 Compliance

We comply with CAN-SPAM (US), TCPA (US), and state-level consumer protection laws (particularly California, Colorado, Virginia). GDPR (EU) and CASL (Canada) apply if we add subscribers in those jurisdictions; we follow them where applicable.

08 The platform we use

Our marketing emails are sent through the Lovable-integrated email system. The platform stores your email, your subscription status, your engagement history (whether you open or click), and any preferences you set. It honors the unsubscribe and suppression rules described above.

09 Updates to this policy

If our marketing practices change — different cadence, different content, new channels — we update this page. Material changes are flagged in the next email you receive, with a fresh option to opt out.
