01 Agreement to these terms

By using cmykink.io or engaging us for services, you agree to these Terms & Conditions. If you don't agree, don't use the site. We mean that warmly.

02 Who we are

"We," "us," and "CMYK Ink" mean THE PRINT GROUP, LLC, doing business as CMYK Ink. "You" means anyone using the site or engaging with us.

03 What you can use the site for

Browse the work. Read the journal. Contact us about a project. Subscribe to the newsletter. Apply for a job if we post one.

04 What you can't do

This is the short version of the Acceptable Use Policy (Policy 05).

• Use it for anything illegal.
• Try to get unauthorized access to systems, data, or accounts.
• Disrupt, attack, or probe the site's security.
• Scrape or copy substantial portions of content without permission.
• Upload malicious files or code.
• Impersonate someone else.
• Misuse the contact form, comment system, or any communication channel.
• Use anything you find here to train an AI model without our written permission.

05 Our services

We provide creative, strategic, marketing, branding, production, consulting, AI-assisted, and design-related services. The specifics of any project (scope, timeline, pricing, deliverables, ownership) live in a separate Master Services Agreement (MSA), statement of work, proposal, or invoice. Where these Terms and the project documents disagree, the project documents win.

06 Estimates and scope

• Estimates are estimates, not fixed prices.
• Timelines are best estimates, not guarantees.
• Revisions beyond the agreed scope may cost extra.
• Substantial scope changes may require a new estimate or timeline.

07 Payment

Specific payment terms live in the MSA or the relevant invoice. Generally: deposits are required before work begins; invoices are due within 14 days of issue; late payments may pause active work; completed deliverables may be withheld until payment is received. The kill-fee schedule is in Policy 12.

08 Intellectual property

Everything on cmykink.io belongs to CMYK Ink unless we say otherwise. You can look at it. You can't copy it, redistribute it, or train an AI on it without written permission. For project work, ownership transfers per the project agreement (usually when the final invoice is paid).

09 Third-party platforms

Projects often involve tools and services we don't control. We pick vendors carefully, but we're not liable for their outages, policy changes, vendor delays, software limitations, account suspensions, API changes, or platform failures.

10 Print production and color

Printed materials vary slightly based on paper stock, coating, calibration, ink behavior, lighting, vendor process, and the screen you're viewing them on. We can't guarantee exact color replication across every medium and device.

11 Disclaimer of warranties

The site and our services are provided "as is" and "as available." We don't guarantee uninterrupted access, error-free operation, specific business outcomes, search rankings, marketing performance, viral results, or compatibility with every device.

12 Limitation of liability

To the fullest extent permitted by Arizona law, CMYK Ink is not liable for indirect, incidental, consequential, special, or punitive damages even if we knew the damages were possible. Our total liability for any claim will not exceed the amount you paid us for the services giving rise to the claim, or one hundred US dollars ($100), whichever is greater.

13 Indemnification

You agree to defend, indemnify, and hold harmless CMYK Ink from any claim arising out of: (a) your use of the site; (b) content you submit or upload; (c) your violation of these Terms; (d) your violation of any law; or (e) your violation of someone else's rights.

14 Termination

We can refuse service, suspend access, or terminate our relationship for breach of these Terms, abusive conduct, unlawful activity, harassment, non-payment, repeated scope abuse, or misuse of intellectual property.

15 Dispute resolution

Before either of us files a lawsuit, we agree to try to resolve any dispute informally for at least 30 days. These Terms are governed by Arizona law, without regard to conflict-of-law principles. Any lawsuit must be brought in the state or federal courts located in Maricopa County, Arizona.

16 Changes to these Terms

We may update these Terms from time to time. Updates are effective when posted on the site. Continued use of the site after an update means you accept it.

17 Severability

If any part of these Terms is found unenforceable, the rest stays in effect.

18 Entire agreement

These Terms, together with the Privacy Policy, the other policies on this site, and any signed Master Services Agreement, are the entire agreement between you and CMYK Ink about the site and our services.
